Terms of Service

1. Acceptance of Terms

By accessing or using the Presto mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the App. These Terms constitute a legally binding agreement between you and Presto Labs, Inc. ("Company," "we," "us," or "our").

2. Description of Service

Presto is a non-custodial digital wallet application designed for the Tempo blockchain. The App allows you to send, receive, and manage digital assets on the Tempo network. As a non-custodial wallet, Presto does not store, hold, or have access to your private keys, recovery phrases, or digital assets. You maintain full and sole control over your wallet and its contents at all times.

3. User Responsibilities

You are solely responsible for:

Safeguarding your private keys and recovery phrase. If you lose access to your private keys or recovery phrase, you will permanently lose access to your digital assets. We cannot recover them for you.
Maintaining the security of your device and any authentication credentials used to access the App.
Ensuring that your use of the App complies with all applicable local, state, national, and international laws and regulations.
All transactions initiated through your wallet. Blockchain transactions are irreversible, and we cannot undo or reverse any transaction once it has been submitted to the network.
Verifying the accuracy of all transaction details, including recipient addresses and amounts, before confirming any transaction.

4. Intellectual Property

The App, including its design, code, graphics, logos, and all related intellectual property, is owned by Presto Labs, Inc. and is protected by applicable copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse engineer or attempt to extract the source code of the App.

5. Third-Party Services

The App integrates with third-party services to provide its functionality. Authentication services are provided by Privy, subject to their own terms of service and privacy policy. The App interacts with the Tempo blockchain, a decentralized public network that is not owned or controlled by Presto Labs, Inc. We are not responsible for the operation, availability, or security of the Tempo blockchain or any other third-party service. Your use of third-party services is subject to their respective terms and policies, and you should review them independently.

6. Disclaimers

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory. We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, or free from harmful components. We make no representations or warranties regarding the accuracy, reliability, or completeness of any content or information provided through the App.

Nothing in the App constitutes financial, investment, tax, or legal advice. You should consult qualified professionals before making any financial decisions. Presto Labs, Inc. is not a financial institution, broker, or advisor.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Presto Labs, Inc. and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of digital assets, loss of data, loss of profits, or damages arising from unauthorized access to or use of your wallet. In no event shall our total aggregate liability exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless Presto Labs, Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, your violation of any applicable law or regulation, or your violation of any rights of a third party.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Because Presto is a non-custodial wallet, termination of your access to the App does not affect your ability to access your digital assets through other means, provided you have retained your private keys or recovery phrase.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you through the App. Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
